We’re talking about something called a Memorandum Title. What is this thing, you ask? Well, in order to explain it fully, and in order to understand just how convenient it is, we’ve got to start from the beginning.
We start with this scenario:
Say you are an Ohio resident with a vehicle that is titled in Ohio. Titled, but not yet registered. But let’s say your vehicle still has an outstanding lien on it – meaning that you’ve purchased a car, truck, or SUV and agreed to pay in monthly installments which have yet to be completed. If the loan on it has not yet been paid off, the certificate of title will show the lienholder’s (the bank’s or the money lender’s) name on the front of the document. Furthermore, the title itself will remain in the possession of the lienholder until the lien is satisfied.
Even if the ride is parked in your driveway and you are making payments on it, you will not be able to actually own the title or have your name listed as owner until you’ve paid your loan in full.
That said, at the time the loan is satisfied, the lienholder will issue an official letter stating that the money owed has been repaid in full. This is called a lien release. This letter allows ownership of the vehicle to transfer to you, and thus the title to be rewritten by the BMV with your name listed on the front as legal owner.
But this is all about liens, you might observe. And where do Memorandum Titles fit in with all this? We’ll tell you. Remember, that in this scenario you have a vehicle that is titled in Ohio but not registered. This means that you’ve purchased a car and are making payments to a bank or finance company, and the lienholder holds the actual title, but the car does not have license plates.
This car is not permitted to be driven on public roads, of course, without registration. But we also know that you cannot apply for registration without a title. You must have a title in order to register a vehicle. So, what do you do in this conundrum? How do you get this baby roadworthy? That’s where the Memorandum Title comes in
A Memorandum Title, which is also called a Memo Title, is a temporary title, an interim title that is issued by your county title office that allows a vehicle owner to obtain registration (license plates) when the original certificate of title is held by the lienholder. In short, this document is a super convenient way of obtaining registration for a vehicle that is only titled and still bears an unsatisfied lien.
It is very important to note, however, that a Memorandum Title is used for registration purposes only.
This title cannot be used to transfer ownership from on person to another. In fact, generally, a vehicle with an outstanding loan cannot be transferred until the loan is paid off. But if you fall into the category of having a titled ride, no registration, and an pending lien in the state of Ohio, this document could make your life a lot easier.
