If you’ve signed off your vehicle’s title, and if it was never transferred, you have a few options available. A car title transfer in Florida is pretty straightforward, and the law may be on your side—depending on your particular case.

Selling and Signing
In Florida, a seller is required to sign the back of a vehicle’s existing title along with the sale price, date and exact odometer reading. Then, the car is handed off to the buyer. At this point, the buyer is expected to register the title. If a sale doesn’t take place at a DMV office, however, the buyer can’t be “forced” to register the car.
Because car owners sell their vehicles frequently, a lot of private car sales don’t take place at the DMV. For this reason, signing and registering can become a complicated process. Before a car is completely transferred, the buyer needs to register its’ credentials. In some cases, the vehicle’s license plate may need to be turned into a local DMV office. From all angles, a vehicle should be stripped of any previous identifying information and be given new information. A vehicle’s registration information ties it to its owner—and a vehicle which isn’t transferred completely may still be linked to its seller.
Ensuring Transfer of a Vehicle’s Title
Understandably, not much holds a buyer responsible for registering a Florida car title. If they get into an accident after driving the vehicle for five miles, the vehicle will still be in your name. Fortunately, you can make sure your buyer is held accountable for completing the transfer.
Make a copy of both sides of the vehicle’s title. Additionally, make sure the vehicle’s odometer reading is exact when you transfer the car. Make sure you secure a complete bill of sale. During the sale, both parties should sign the papers. Send the bill of sale to the DMV. If anything happens to the vehicle, and if the buyer has failed to register the car, you—and the DMV—will have proof of the transfer. The car won’t legally be in your name, relieving you of any responsibility.
What Happens if You Don’t Ensure a Title Transfer?
If you don’t copy any documents, inform the DMV and hold the buyer accountable, you could receive traffic tickets in the mail. It’s important to let the DMV know about all aspects of the transfer. Contact them immediately after the sale is completed, and circumnavigate any future charges before they occur.
In most cases, a buyer simply forgot to make the transfer quickly. If the vehicle still hasn’t transferred, give them a week or so. If they still haven’t registered the vehicle, immediately contact your local DMV office. If they have the records, the situation will be quickly remedied. As in any case involving automotive, proof is your best resource. Selling a vehicle can be profitable, but it can also create an opportunity for individuals to use a seller’s name during crimes.
Overall, these cases are rare. The DMV supports a buyer’s security, and Florida law will similarly back up a seller whose vehicle wasn’t properly registered by the buyer. Take the extra step of protection, and make sure all selling information is handled correctly. If you’re on the buying end: Make sure you transfer the vehicle quickly.

Hello. I am Massachusetts- My sister gifted me her car in July because she was planning on moving across the country to get her life together (she was a drug addict). At that time I didn’t transfer the title because the car needed work and I also had a leased vehicle that was paid off and I wanted to finish out my lease. 3 weeks after gifting me the car, my sister passed away. I have the gifted/bill of sale and tile (in her name) both signed 07/20/22 by both of us. I just gave my lease back and I’m worried that because the title was signed 8 months ago it’s going to shoot back at me. Will it be possible to use the gifted/bill of sale and title that was signed 8 months ago to change the title to my name and register the car?

I’m in CA. Over 10 years ago my parents purchased a car for me from private party. My parents are on title as owner and or lien holder, I don’t remember. I have been using the car ever since, paying registration and insurance all under my name. End of 2018 my parents signed and dated title to transfer to me and or release lien however it was put to the side and then misplaced. I recently found it. Documents were never turned into DMV. What needs to happen if I want to sell it or donate it now since title was already signed and dated almost 2 years ago? Also, if I donate it do I have to pay for registration tags that are due in Dec and get smog cert? Thanks as I was not able to locate this info on the web.
If you choose to sell or donate the vehicle without first putting the vehicle in your name you can do so with a bill of sale. The original signed title and bill of sale will need to given to the new owner. The new owner will be responsible for any fees due. The seller is responsible for the smog unless other agreements have been made.

Live in PA a friend sold a car to a person she didn’t know. He paid her cash but won’t transfer the car now and has blocked her number and won’t answer to other numbers that have tired to call him. Hi, I live in South Carolina and 2 weeks back I bought my first motorcycle and the title came with it but it was never transferred into the sellers name but his name and the original owners name are on the title and we signed a bill of sale with his info and mine. Hello im so sorry to jump In here but i couldnt find where to post. I bought a boat and the title has my name on it as a buyer. I never had the title in my name and i havent even signed it as its very hard to get to the dmv with covid. I now want to sell the boat. Do i have to record the title and then sell it or can i just white out my name and put the new buyers name and make a bill of sale? I dont want the buyer to have an issue. He signed title over to me however when he bought the trailer from a dealer in California they mistakenly issued him title to the wrong ViN they corrected it and sent him the correct one. Of course though he gave me the wrong title. Spoke to dealer who sent form to request duplicate title and transfer of ownership, however now the seller is not responding to me. You will need to bring all supporting documents to DMV including any bill of sales. The DMV will provide a statement o record ownership form and determine if the title will be accepted with the whiteout.

Hi. Thank you for offering this discussion. I have a person who signed the title, but signed in the wrong place that as the seller, he signed in the buyer field. I then signed next to him, but did not catch his error. I went to register the vehicle and they put a red X on the title and told me I have to get him 2 have a notarized signature – and to notarize & an affidavit form.

Unfortunately, they only way to remove the vehicle from your name is by doing a title transfer. In the event, the person who has possession of the truck has taken it out of state, the only way to go about it would be to provide documents from the sales such as a copy of the title or bill of sale, to a tag agency and have the status of the title marked as “SOLD”. However, that does not remove vehicle from record.
In Florida, my friend junked her car. She didn’t owe anything on it and they offered her 15 dollars for the junk. She didn’t take the money because she didn’t see the point. There was no receipt or bill of sale and at the time she couldn’t find the title. She found a letter that came to her awhile ago saying she owed the junkyard for “holding the vehicle”. She now owes over 1075 dollars (25 dollars per day). She’s recently found the title. Does she really owe them this money? How can she transfer her title and why didn’t the junkyard ask for this paperwork? Does she need a lawyer?

In the DMV’s records, you are still the the registered owner. Legally though, the person with the signed title is the owner. We recommend seeking professional legal advise on what you should do regarding the new owner’s failure to complete the transfer. I called them, and started making payments on my account. I went to the dealership to see what i can trade off for my car, and they informed me that the title is not in my name and nothing on my credit report. If the vehicle is registered in your name and titled, then you are now the sole owner of the vehicle. Any issue in reference to money owed or not paid will be a small claims issue not MVA.

You will want to protect yourself by completing a Notice of Sale (Form 82050), which removes your name from the vehicle so you are no longer liable for the vehicle you sold.

I purchased a motorcycle for my boyfriend and later broke up. We agreed to return gifts given to each other and the motorcycle was one of these returned gifts. We went to a notary together, he signed the title over to me, I completed the back had it notarized and mailed it to the DMV. He retained possession of the bike and he stored it for me. Time passed and I tried to get plates and learned that the change of owner wasn’t processed. I told him this and he apparently got a duplicate title. More time passed and the completed title (with him signing over to me) showed up in my mailbox “returned to sender.” So, here I have a title signed, notarized, dated, etc. that was never processed. I’m originally from PA. I moved to GA. I went and got new state license but when I went to get GA. tags I missed placed my title.. I found the original copy of title I signed at dealership though that they copied with my paperwork. Will they except this. And the original copy of title I sign also then had a lien.
Please note we don’t operate in GA, you can always call your local DMV. But most likely… If you have the original title, it should be accepted. Now if it’s a copy, contact dealership to obtain a duplicate title and all supporting documents.
Hi I was gifted a vehicle by a previous employer as a kind of bonus. The vehicle sat at my house for awhile as I was doing repairs on the vehicle. During this time I never went to DMV to transfer the title into my name. The title I have looks like a bill of sale and includes price, odometer reading, addresses, and spots for signatures. This was the equivelant to a bill of sale and title all in one I was told at the time of signing it by my old boss and was all that was needed. It even said GIFT in the spot for price of the vehicle.
Long story short is a couple months later I finally got the work done on the vehicle and took it for a quick test drive. While driving I got pulled over for no plate and the vehicle was impounded. I had stopped working for the boss who gave me the vehicle and we had a bad falling out. He must of have got notified by the impound yard because he went and got the vehicle himself after securing a new title. Now he won’t give me the vehicle back after all the money I put into it saying I lost out. I thought once the title was signed ownership transferred to the buyer. He is breaking the law by taking the vehicle and acquiring new title himself isn’t he? Should I call the police and show them the title I have signed by all parties to get the vehicle back? It is the sellers job to notify the DMV of a sale to protect themselves. I live in Florida by the way. Please advise to my next options I just put a lot of money into the vehicle and don’t want to see it lost.
Assuming that the previous owner used the Form 82050 Bill of Sale, showing both Buyer and Seller signatures, the new owner has all rights to the vehicle. This issue may not be resolved by calling a cop. You may need to go to court.

yes, you can. since he already signed the title, all the buyer would have to do is sign the purchaser portion. No additional documents are required as long as no mistakes are made on the title. Make sure to complete all seller portions being the sale price, date sold, and mileage.
Well he did not date it, he left it open. If I sell it for example tomorrow, do I date it 02-21-20 or does the date have to coincide when he was still alive? I do not want to make any mistakes; however, I want to sell the car soon so that the car insurance can be cancelled (do not want to have the car uninsured even if it is parked). what we’re understanding is that the seller has signed as buyer, if that’s correct you’ll have to him correct it by him signing a miscellaneous affidavit to correct the mistake. If he’s not responsive, we suggest getting a court to award you the vehicle

It depends on whether your title has multiple signing sections. For example, a FL title would be ‘ruined’, if it’s a CA title you’d have another section you can sign.

Hello, im a Maryland resident first of all. In November 2014 i left my ex of 10 years. He had bought a Toyota tundra previous. He had gotten so many tickets and noone would give him decent insurance rates, so we signed everything in my name. Everything was fine until we broke up. I signed the title over to him the night i left. In August 2015 i moved to Florida with my father for alittle over a year. I was employed in Florida. I moved back to Maryland and receved a letter a year later from the comptroller of Maryland stating i owe the mva $6000 for the Toyota tundra. Im guessing he never transfered the title n stopped paying insurance. Well then he sold it and bought a vehicle. So im wondering in order to do that he had have then transfered the title and turned the tags in. Now i can drive because i owe them so much money. Do you think if the mva will see all this information in there systems and realixe he is the true person who owes them? Please help me. Im desperate.
If you don’t have a bill of sale, it’d be a good idea to contact a lawyer and explain your situation. It is unlikely that the MVA has any of this info.
I sold a car the other day in Florida. I’ve never done that before and was not aware of all the necessary things. I signed the title and the buyer took the title and basically drive away. So, because of my serious lack of experience I now don’t know the buyers name and I don’t have a notice of sale or bill of sale. I tried messaging the buyer to get his name and address to the notice of sale so that I could take it to the local DMV. If that does not work, should I contact police or talk to DMV? I don’t want this to come back and haunt me later.
To add to the previous message. I had removed the licence plate from the car, so at least that should help. I think the guy is a title jumper, and assume that when he possibly resells the car, someone has to register the vehicle in order to use it and then the title will be transferred. Is this correct?

The tags expired in 2015 but he never put it on his name nor the title was on his name. Luckily found the titled owners phone number that sold the motorcycle to my friend, Asked him that I need a duplicate of title form to be signed by him, so I asked him if I could send him the paper to get the signature, at first he was cool about it, later that day I called him and asked him I would send him the form via email so I could take care of the paperwork that same day. He said he would sign them when he had a chance cause he was driving, it’s been a week now and never got an answer from him and now he won’t answer my calls. I talked to my friend whom I bought it from and said that I could get it registered with only the bill of sell.
The bill of sale only shows proof that the previous owner sold it to your friend. Your friend will have to get a title in his name in order to sell it to you. Contact your local DMV or tax collector for more info.

Hi glad i found this article.. I have a question, I sold myh motorcycle to a guy a couple months ago in april i singed the title and did not date it. A couple weeks later i got a ticket in the mail for a toll violation this was mid MAY. i contacted him and he said he sold the bike to someone else. So i contacted the toll way and they said i would have to show that i did a vehicle title transfer thing so i would not be liable for any tickets or anything. So i did that and got the paperwork and email stating the vehicle transfer mark was placed on the vehicles record with the date i gave them. Well fast forward Its JUNE 21 and i get another ticket for yet another toll violation. whoever has this bike still has not transferred the title and is title jumping.
My question is this, if this bike is ever impounded since it is still legally in my name and i am ever notified, Can i pay to get it out of the impound and go to the DMV and request a new title even though i did the title transfer notification since i will have the bike back in my posessesion? Hi so I live in WA state, husband bought me a quad from OR, got a bill of sale and the guy that sold it to my husband said he had the title. The guy is in the middle of moving and his house was in disarray. Husband paid and left with the quad. It’s been almost a month and rhe guy is claiming he still cant find the title. I called Oregon dmv with the vin and the guys name and he never registered it. I found a crunched up registration from 2006 in the tool bag under the seat and found the original/registered owner in wa state. Dmv told me report of sale was done in 2011. I know I will have to apply for a 3 year registration w/o title. My question is, since the legal owner released ownership of the vehicle in 2011, can he take it back? I’m scared I’ve lost all my money in this situation. I reached out to the registered owner and he has no interest in meeting up or signing paperwork since he did it in 2011.

According to the dmv the legal owner can’t take it from me nor can he now report it stolen since he reported it sold 8 years ago. A friend took a car I owned to sell it for me. It had been my fiancé’s car. He had died a few months before my friend took the car to sell for me. After my fiancé died, I did apply for a new title, in my name, and purchased a new license plate, but I never drove the car so I never changed the license plates. My friend did not take the car to sell until I received the new title in my name. When my friend took the car to his house, my deceased fiance’s license plate was still on the car, but my friend took the new license plate with him so he would have it in the car in case he was stopped by the police. My friend lives right down the street from me, so not far. Once he got the car to his house, it was only driven, on a test drive, by the guy who bought it. My friend knew the guy buying it. I never got insurance on the car and my friend never put the NEW license plate on the car and he DID NOT give it to the buyer, he kept it. Once my friend sold the car, to the guy he knew, he collected the purchase price of the car from the buyer, $2,500, in cash. When my friend gave me the money, I signed the title (but did not date it) and gave it to him to give to the buyer. At that point the car was still at my friend’s house. I also signed a Bill of Sale that had a place for me (the seller) to sign and a place for the buyer to sign. My friend gave the Title and the car to the buyer and had him sign the Bill of Sale. My friend gave the Bill of Sale to me. I only have a copy of the FRONT of the title, not the back where I signed it and not a copy showing the buyer signed it. I called the tax assessor’s office and advised them of the date of the sale. They noted it in their system. I did not know I needed to let the DMV know about the sale. I sold the car on March 15, 2019. It turns out the buyer bought the car for his loser son, and on April 1, 2019, the son hit another car. He totaled the car he was driving (the car I had sold to his father) and caused damage to the car he hit. The son lied to the police and said the car belonged to a friend and neither the son, nor the dad, had insurance on the car yet, and the dad had NOT applied for a new title yet. At the accident the officer ran the VIN number and it came back showing me as the owner. I guess he gave the guy who was hit my name and address because that information is not on the police report. I received a letter from the insurance company of the guy who was hit wanting my insurance information. I did not give it to them (it was the claims office of the insurance company). I told them I had sold the car to the father of the guy who was driving the car that caused the wreck. She told me if I would fax her a copy of the Bill of Sale then I would not be pursued by them anymore. I sent it to her, but I am still VERY CONCERNED. My friend kept the new license plate that is in my name, but has misplaced it at his house. He has assured me the new license plate, in my name, DID NOT go with the car, or the buyer. He is looking for the new license plate owner so he can give it to me and I can then turn it into the tax accessor’s office. When the accident happened the car had my deceased fiance’s EXPIRED license plate on it. The father (the buyer) had not applied for the new title before the car was totaled by his son and neither of them had insurance on the car. I feel sure the father did have insurance on his everyday vehicle. Do you think the guy who was hit (his insurance company) can legally go after the buyer since they now have a copy of the Bill of Sale, or do you think they WILL still come after me for payment? If they do come after me, do you think my insurance company (the company I have MY CAR insured through) will “cover” the car I sold, so that they will pay for the car that was hit, to be repaired, under my uninsured motorist coverage? Texas: in 2013 i bought a travel trailer from a person i no longer have contact with. Very complicated situation. I bought a salvage car last year. The Florida title was issued to Progressive Insurance who transferred the title to a car dealer in Nebraska (who went out of business) who then transferred the title to me (all transfers on the same title). All previous owners are on the title (Progressive and Nebraska dealer) including me as the current owner. However I lost the title. I have a copy of the Bill of Sale and copy of the Title but dont have the originals.

Hello, I sold a car in Highlands County FL on March 2018. I filled out the top portion of the title (the tear off part) and submitted it to the DMV. The insurance claim was set and adjustment was made. Now there was an issue my vehicle was in the process of being registered to my name. In the moment of impact I was the driver. This reply was no help. I am in a similar situation. Someone stole the title out of my suv 4 days after I bought the vehicle. I never even had a chance to transfer it into my name. So you mention title is signed but we’re assuming it’s never been actually transferred, meaning submitted to DMV or other system like eTags. If it’s never been transferred, it’s still legally her dad’s. If it was submitted it would legally be yours.

Now since it appears that he has the title with him, he may be able to title the vehicle with the local DMV. As you said, the original owners filled out the title incorrectly so it may help but it depends on what the document says. I have been gifted a Hyundai sonata by my grandparents in new Jersey but I am moving to Florida. To make things easier on me, they told me I can be on their insurance to drive down there and just register when I get there. I already have the title, is there something they need to sign outside of that, and they don’t have to be present when I change the title, right? Hello. Quick question on a really bad incident. On Christmas day a couple guys came by my house and wanted to buy my car that had a very bad oil leak. I explained to them the issue and they still wanted it. So I sold it to them for $700. We signed the title and I have a handwritten note signed by me and him acting as a receipt. Fast forward till May and this is were the issues start. I tried to pay for my tag renewal and they said there was a lien on my car that I own! So I called the place that put the lien on the car and the guy I sold the car to had got a DUI and rolled the vehicle 5 times! Now they are saying I owe over $800 and I can’t get a new sticker for MY car. I’m just wondering of the handwritten receipt is enough proof that the car was sold??

I am considering buying a car off ebay using the escrow.com service. Apparently they do title collections and they don’t really have anything i could email them by to ask this question. I was hoping you’d know. If i buy a car without ever meeting the seller, Escrow has a method of sending me a pdf copy of the title to make sure the vins add up once I receive the car and that it’s signed. Hello, I bought a car from my friends mom who bought it for my daughter but told her we had to make payments on it. She bought the car from her neighbor. They fist told me the truck was $1500 but when I went over there, it was all of a sudden $2000. I felt very pressured and obligated as she said she did this so my daughter would have a car to drive. (they lied to not pay much taxes) Can I get out of this promissory note to pay this since she lied about multiple things and it is no where near $2000

We signed our portion and gave it to him to sign but he insisted his ‘wife’ will sign it and he gave us the top portion of the title with just her name and nothing else. I sold my car in Arizona but it had an Oregon title. I signed over the title to the buyer and notified OR DMV of the sale. The buyer has not removed the vehicle from my property and has no contact in 5 days. I called Oregon DMV, first I was told AZ laws and procedures would apply but AZ DMV says they cannot help because the car was never titled in AZ. I sold my car on the 1/16/18, and I recorded it as sold via online Wa State DOL on 1/17/18. The buyer calls me on the 18th asking me to fill out another form dating it differently because he couldn’t afford to transfer the title just then. WHAT DO I DO, EVERYONE I KNOW AND ALL OF OUR MUTUAL FRIENDS KNOW HE BOUGHT THE CAR FROM ME AND NOW HE IS STICKING ME WITH EVERYTHING, CAN I SUE HIM FOR THIS.
