So you decided to gift your car to a family member. You live in Florida and your car is registered in Florida. Make sure the lucky recipient understands the responsibilities behind car ownership. Sure, getting the vehicle for free seems like a no-brainer at first, but mentioning the maintenance fees such as repairs and car insurance, as well as yearly registration renewals and the like, are none the less responsibilities.

Gifting a car in Florida is just like privately selling a car. The gift-giver/seller/you has to follow the same steps, including signing over your Florida car title to the recipient/family member. The gift recipient, on his/her end, has specific steps to take in order to complete the transfer.
Step 1: As the gift-giver, check that there’s no lien
Before transferring over your car title to the recipient, make sure there’s no outstanding lien on the vehicle. In other words, that no third-party has financial interest due to an outstanding debt. For example, the bank that loaned you the money to buy the car in the first place. Before gifting your car in Florida, make sure the vehicle is paid off. Note: Once you’ve completed your car payments, your lienholder should’ve electronically contacted the Florida DMV and notify them.
Step 2: Sign over the title to the gift recipient
As the gift giver, you must sign over the Florida car title to the new owner (the one receiving the vehicle as a gift). Make sure you correctly fill out the blanks in the bottom portion of the Certificate of Title. Print your name and signature legibly, and remember to put the word GIFT by “selling price.” Also, note that by the odometer section, the number “5 and 6” represent whether the car can support 5-digit and 6-digit mileage, not what the odometer currently reads.
Step 3: As the gift-giver, write a Bill of Sale. Not a must-do, but it will protect you
You may be thinking it’s a gift, not a sale, but remember gifting a car in Florida is just like privately selling the vehicle to a buyer. A bill of sale will ensure that you, the gift-giver, is NOT liable for the car after the contract (Bill of Sale) is signed. This protects both of you and recipient.
The Bill of Sale form HSMV 82050 includes sections for both the gift-giver/seller and gift recipient/purchaser. It also features spaces for the vehicle’s details such as make/model, Certificate of Title (which proves that the gift-giver is the actual owner of the car being gifted) and more. Until the title transfer takes place, the Florida Department of Highway Safety and Motor vehicles won’t update the ownership status.
Step 4: The gift recipient needs to complete a title transfer
The recipient has two ways to transfer the FL car title when gifted. One way to do it is to go to their local FL DMV with you, the gift-giver, wait in line and fill out the paperwork there including a Certificate of Title. There will be title fees and registration fees, because now the car will be under new ownership. There will be no sales tax because the vehicle is a gift.
Or the gift recipient can go the online route and do the Florida title transfer right from the comforts of their own home. No traffic, no traveling, no problem! eTags will walk them through the process and ask them to upload all documents needed to complete transfer. They’ll also have the help of a title transfer service specialist should they need assistance completing the order or have any questions. They’ll need to provide eTags a completed application for Certificate of Title and power of attorney form. Once they start the online process, they may be asked additional support documents. For example, if they’re part of U.S. Armed Forces.
Step 5: The recipient now needs to get a Florida car registration
When it comes to gifting your car, for the recipient to be able to drive it, the vehicle has to be registered. Title transfer kind of goes hand in hand with car registration and happens simultaneously. The title itself establishes ownership, while the registration establishes the legal right for the car to be driven on public roads. In fact, the Certificate of Title form is called Certificate of Title With/Without Registration. To register the car, the gift recipient will have to show proof of insurance with a Florida Insurance Affidavit form. Once they register the car, they’ll get their new license plate because plates can’t be transferred when a vehicle is gifted.
Don’t forget, a Florida car registration has to be renewed every year or every two years. The good news is that by using eTags online vehicle services, renewals can be done with just an internet connection. You will need the clear, Florida title in order for your son to be able to title and register the vehicle in his name in Maryland. In many cases, the finance company will issue the clear title automatically once the lien is satisfied so we recommend contacting your lender to confirm. If you they already advised you that you can obtain the clear title directly from the FL DMV, you can either order it online if the title is electronic or visit a tax collector or tag office to obtain a replacement paper title. You may also order a replacement paper title online with eTags. Once you have the title, you would complete and sign the sections for the “seller” and your son would complete and sign the sections for the “buyer”. Then he can transfer the title and register in Maryland at an MVA office or online with eTags.

Since you plan to register the car in Indiana, it is best to confirm with the Indiana BMV how the title should be signed over. For example, if you were going to register it in Florida, the FL DMV would require that your mom sign her name followed by “Attorney in Fact”. Its important to note that we state this based on the fact that you stated she has Power of Attorney and not some other document. If, for example, she were executor of an estate, the way she would sign would be different because the document granting her that authority would be different. Still though, this would be how Florida handles things. Unfortunately, DMVs across states and even across counties can have different requirements. If you find that Indian’s requirements are difficult and restrictive, you may want to consider transfer the title to your name in Florida and, once you have an FL title in your name, then register it in Indiana if their requirements are less demanding if the title is already in your name. Your only consideration here is how you would be taxed in Florida (no tax for gifted vehicles) versus Indiana. That might be alot to absorb so the best first step is to contact the Indiana BMV to confirm their requirements when a vehicle is registered involving a “seller” with Power of Attorney. Best of luck!

Hi Addison, assuming that we are understanding you correctly that car has a Missouri title in your father’s name, then you only need to have your father complete and sign the title as the “seller”. With the completed/signed Missouri title in hand as well as your ID and Florida insurance, you only need to walk into any Florida Tax collectors office or tag agency to transfer the title into your name and be issued both a Florida title and Florida plates. My parents signed their title over to me “or” my husband (for gift tax purposes it is going to both of us to comply with the gift reporting limit of the IRS. The short answer: No. If your sister wishes to use the vehicle as a trade-in, it’ll need to be in her name. She doesn’t need registration in her name. Just the title would suffice. The other option would be to have your dad sell the car to a dealer for cash value and give the money to your sister. Yes, you can gift the car to your son; however, your address can only be used if your son can provide proof of residence that proves he receives mail there (any piece of mail with his name and requested address reflected). Alternatively, if he is unable to provide proof of residence, he can simply provide a notarized letter that says we can use the requested address to mail the order. We can also use the TX address on his ID, but that will also be the address that will be printed on the title once it is processed. The proof of FL insurance that only reflects your name will be acceptable. Sure the process can be completed online. Follow this link to place an order! I am Gifting my vehicle which I own with Title in my name to my son. I Signed the title, and so did he and we entered GIFT for selling price, along with odometer and we also filled out the top section on back of title for the DMV notice. We filled out all 3 sections of the HSMV 82050, and we both signed it. I am using E-Tags to do the transfer of title and new registration for new tag with him, but I have questions:
1) On HSMV 82050 do we check the box “Notice of Sale” or “Bill of Sale”?
2)E-Tags wants me to upload proof of insurance (Copy of card) currently he is under my insurance and would like to stay on my insurance but my name is on the insurance card not his, but he is listed on my policy, and the “Gifted” vehicle is listed under my current policy, will this work and meet the requirements, or does he have to get his own insurance (new policy number) with his name as policy holder before uploading insurance card for the vehicle?

1. Hold on to your HSMV 82050 because you may not need it. As long as the title is filled out completely, and there’s a spot on the title to indicate it’s a gift, you don’t need to submit the Notice of Sale form. The great thing about eTags is that we’ll provide all of the forms you need and they’ll usually be pre-filled for you!
2. As long as your insurance is valid, and lists the vehicle information, it’ll be accepted. Most times, the insurance company will only list the name of the person paying for the policy and we get that! No need for your son to get a new policy.

Because the car has a lien, you won’t be able to obtain a Florida registration or tag in your name without going through the lien holder. If, for example, the lien is from an institution that financed the purchase of the vehicle, you could contact the lien holder to see about refinancing the loan to be in your name or both your names. Then, you can obtain a Florida registration. Alternatively, if your father has any intent to move to Florida, then the vehicle can be registered with FL tags without making changes to the lien.

The better option would be to gift the vehicle to your son. The benefit of transferring as a gift is exemption from paying sales tax, if a monetary value is entered, the state will collect taxes on the sale price. In regards to obtaining a license plate, unfortunately, tags are not transferable between owners ,however, considering your son’s military status, he may qualify for a military discount on the license plate and registration as long as he has a Florida driver’s license. Completing the transfer remotely is possible, just simply an order on our FL eTags website here choosing the service type “Transfer your title”. Once the order is placed, you son will be prompted to submit an image of the original title, driver’s license, proof of insurance and a copy of recent military orders.

Hi. If a title has 2 names on it, a husband and wife, then sadly the husband dies and the wife does a Bill Of Sale for $1.00 (one) dollar for the vehicle that was listed in both their names as his name OR her name.

Purchased a used car (Private Sale) Cant get into the DMV until 2 weeks because it was the earliest appointment they had being that the offices are by appointment only during COVID.
