Does the DMV in Florida keep your POA affidavit?

I got a POA last year on my moms car that I have to renew the tag. The lady at the DMV never gave it back so I'm wondering if they keep it on file? I'm about to sell the car and I want to make sure I can sign as POA without the affidavit.

While the Department of Motor Vehicles is a state-wide department, in Florida, DMV services are handled by the Tax Collector's (TC) in each county. There is no a state-wide system where the PoA would be available. You can contact the TC office where you turned in the PoA to see if they still have it as they may simply file it away to keep on record. However, it's going to be the buyer's responsibility to transfer the title once you sell the vehicle. While you do have a duty to provide a buyer a properly signed title, they will need to complete the transfer and, depending on which TC office or tag agency they go to, they may or may not be required to provide copies of your PoA or an affidavit.
